Areas of Practice

Next Steps for Families, LLC is licensed by the State of Arizona Supreme Court Licensing and Certification Division to act under Superior Court appointment as Guardian, Conservator, Personal Representative, Special Administrator, Trustee, and Special Needs Trustee.  When serving under Powers of Attorney, Next Steps for Families, LLC is authorized to act upon the terms of the signed instruments.  Next Steps for Families, LLC provides a systematic and individualized approach to services, accountable to the client and the court for communication, documentation and annual report compliance.

 

Guardianship

When appointed as Guardian, we ensure that the all-encompassing needs of the individual are provided.  We consider the known preferences and lifestyle of each individual.  The fiduciary makes decisions utilizing known preferences and best interests to provide the best individualized care, while preserving the quality of life for the individual, in the least restrictive environment. 

We assess for benefits eligibility, apply for benefits and maintain detailed and accurate records for annual reporting and in compliance with the court order.       


Personal Representative

As Personal Representative, we serve in accordance with the court order and statutory requirements.   Assets are marshaled and inventoried as part of the estate property and then administered for the benefit of the decedent's beneficiaries. Final taxes and distributions are made accordingly.

We prepare final tax returns and maintain detailed and accurate records for the final accounting to the beneficiaries and in compliance with the court order.                                                                                                                                                                                                                                                        


Mediation

It is not uncommon for families to find themselves at odds in the midst of family change and transition.  Mediation involves the use of a skilled neutral third party who does not have the power to impose a solution, but rather assists the parties at arriving at their own solution.  Thereby allowing parties to maintain control over the process and agreement that may occur.

We can assist parties with communications through a mediation session.  The mediation will provide parties with greater understanding of the current issues and allow parties to resolve issues and document an agreement.



Conservatorship

When appointed as Conservator, we are responsible for the preservation of the client's property and financial matters.  This includes securing and marshaling of property as well as management of all assets, financial affairs and investments.  As Conservator we consider past preferences lifestyles and are responsible for making prudent decisions on behalf of and for the benefit of the protected person.

We assess for benefits eligibility, apply for benefits and maintain detailed and accurate records for annual reporting and in compliance with the court order.          


Power of attorney

As power of attorney, we serve in accordance with the estate planning documents you have prepared in advance. We are prepared to serve upon the incapacity or disability of the grantor, as defined by the instrument.   As Power of Attorney, we adhere to the same high standards as court appointed cases, acting with the capacity and powers granted in the power of attorney documents.

Trustee

As Trustee, we are bound to act in accordance with the governing Trust instrument.  This may include, Special Needs Trusts, Decedent, Charitable, Spendthrift or Asset Protection Trusts.  As Trustee, we work with the individual to ensure that the purpose and intent of the trust is achieved.   As the Special Needs Trustee, we work with agencies to maximize benefits and eligibility for the Trust beneficiary.

case management

As case management providers, we coordinate and serve individuals and families in cases where specific legal authority is not required.  When serving in this role, the parties are in agreement and the role is defined in a service agreement plan.  We have seen this to be feasible where all parties agree that Next Steps for Families, LLC will act to coordinate services, caregiving providers, assist with budgeting and paying bills or service as representative payee.
